1. Services Offered
Custom Beef and Game provides meat cutting and processing services based on customer orders placed through this website. This includes, but is not limited to, custom cuts, packaging, and preparation of various types of meat (e.g., beef, pork, lamb, wild game, poultry). 2. Ordering and Payment
Order Placement
All orders must be placed through our website’s designated ordering system. By placing an order, you represent that all information provided is accurate, complete, and current.
Pricing
Prices for fixed price products are listed on our website and are subject to change without prior notice. The fixed product price applicable to your order will be the one displayed at the time of order confirmation. Prices for meat cutting are not fixed, and include harvest fees applicable to the customer’s share of the carcass, meat processing fee based on the carcass weight, and any optional fixed fees charged by the pound such as tenderizing, curing, smoking, or by item count, such as packaging and wrapping. Because these fees are defined by the weight of the meat, they cannot be accurately presented at the time when cutting instructions are placed. The final custom cutting cost will be invoiced to the customer when the meat is hung and cut, and customer selected options are updated by Custom Beef and Game.
Payment
Payment for services is required at the time of order placement or upon pickup/delivery, as specified during the checkout process. We accept various payment methods as indicated on our website. All payments are processed securely. CutPlanner™ and Custom Beef and Game are not responsible for any issues arising from third-party payment gateways.
Order Confirmation
Upon successful order placement and payment, you will receive an email confirmation of your order. This confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell; we simply are confirming that we received your order. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.
3. Customer Responsibilities
Meat Quality and Origin
For services involving meat supplied by the customer (e.g., wild game, custom-raised livestock), you warrant that:
- All meat provided is wholesome, fit for human consumption, and has been handled in accordance with all applicable food safety regulations and guidelines.
- You are the legal owner of the meat or have full authorization to commission its processing.
- You will disclose any relevant information regarding the animal’s health, feed, or medication history if requested or required by law.
Pickup/Delivery
You are responsible for picking up your processed meat within the agreed-upon timeframe or for ensuring that someone is available to receive deliveries, as applicable. Failure to pick up or receive processed meat within a specified period may result in storage fees or, eventually, disposal of the product at your expense, without refund. We will communicate pickup/delivery windows and requirements clearly.
4. Processing and Lead Times
Processing Standards
We adhere to high standards of hygiene and food safety in all our processing operations. We aim to fulfill orders accurately and according to your specifications. However, due to the nature of custom meat processing, slight variations in weight, cut appearance, or yield may occur.
Lead Times
Estimated lead times for processing will be provided on our website or at the time of order. These are estimates only and are subject to change based on demand, unforeseen circumstances, or force majeure events. We will endeavor to communicate any significant delays promptly.
5. Cancellations, Refunds, and Returns
Cancellations
Cancellations of orders may be permitted within a limited timeframe after placement and before processing has begun, subject to a cancellation fee. Please call Custom Beef and Game for detailed information.
Refunds
Due to the perishable and customized nature of our products, refunds are generally not offered once processing has begun or completed, unless there is a verifiable error on our part regarding your specific order specifications. Any issues must be reported immediately upon pickup or delivery.
Returns
Meat products cannot be returned once they have left our facility due to food safety regulations. If you believe there is an issue with your order, you must notify us immediately upon the pickup of your order so we can assess the situation.
6. Disclaimer of Warranties; Limitation of Liability
The service and all products/services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall CutPlanner™ or Custom Beef and Game, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

You agree to indemnify, defend, and hold harmless CutPlanner™ and Custom Beef and Game and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

These Terms shall be governed and construed in accordance with the laws of the State of Colorado, USA, without regard to its conflict of law provisions.
9. Changes to Terms
